PowerMarketing Affiliate Program — Terms of Use

Welcome to the PowerMarketing Affiliate Program. These Terms of Use ("Terms") govern your participation as an Affiliate and the relationship between you and PowerMarketing. By joining the Program, you confirm that you have read, understood and fully agree to the conditions below.

1. Definitions

• PowerMarketing: the email marketing and newsletter platform operated by Global Innovation Technology.
• Affiliate: the individual or company who voluntarily joins the Program and promotes their Coupon to refer new customers.
• Coupon: the Affiliate's personal, exclusive code that grants 20% off to any new customer who uses it.
• Cashback: the amount the Affiliate receives — equal to 30% of every payment actually made by the customers they referred, for as long as those customers remain subscribed.

2. Nature of the relationship — autonomy and no employment link

2.1. The Affiliate is free and independent. Joining the Program does not create any employment, corporate, commercial representation, formal partnership or subordinate service relationship between the Affiliate and PowerMarketing.

2.2. There is no — and is not intended to be — subordination, habituality, personal-service obligation or exclusivity. The Affiliate keeps no working hours, takes no orders, has no mandatory targets and is not subject to control over schedule or working methods.

2.3. The Affiliate organizes their promotional activity however, whenever and wherever they wish, at their own account and risk, bearing their own costs and any applicable taxes.

2.4. The Affiliate may involve other people to help promote and refer their discount Coupon, at their discretion, provided those people also comply with these Terms and the conduct rules herein. The Affiliate is responsible for the conduct of anyone promoting on their behalf.

3. How it works

3.1. Upon joining, the Affiliate receives an exclusive Coupon.

3.2. Anyone who uses the Coupon gets 20% off their PowerMarketing subscription.

3.3. For each confirmed payment from a referred customer, the Affiliate accrues Cashback equal to 30% of that payment — including renewals, for as long as the customer stays subscribed.

3.4. This is not a commission. The Affiliate's benefit is called Cashback and does not constitute payment for work, salary, fees or any labor-related compensation.

4. Cashback payment (via Stripe)

4.1. Cashback is credited to the Affiliate as the referred customers' payments are confirmed.

4.2. Each Cashback amount goes through a release period of up to 45 days, counted from the confirmation of the corresponding payment. This period covers possible reversals, cancellations, refunds (chargebacks) and disputes.

4.3. Once released, the Cashback becomes available for payout and is deposited into the Affiliate's Stripe account. The Affiliate is responsible for keeping a valid, active and properly verified Stripe account to receive the funds.

4.4. Amounts relating to reversed, refunded or disputed payments do not generate Cashback and, if already credited, may be deducted from future balances.

4.5. PowerMarketing is not liable for delays or holds arising from Stripe requirements or policies, nor for taxes owed on amounts received by the Affiliate, which are solely the Affiliate's responsibility.

5. Conduct and ethics

The Affiliate agrees to promote PowerMarketing honestly, transparently and respectfully, in particular:

• Presenting PowerMarketing truthfully, without exaggerated promises, guarantees of results or misleading information;
• Identifying as an Affiliate where relevant to avoid misleading third parties;
• Complying with applicable law, third-party rights and good market practice;
• Treating customers, potential customers and the PowerMarketing team with courtesy and respect;
• Protecting the image and reputation of the PowerMarketing brand.

6. Prohibited practices

The Affiliate is expressly prohibited from, among other bad-faith conduct:

• Spam or sending unsolicited bulk messages (email, SMS, messengers, comments, forums);
• Using misleading, false or guaranteed-result advertising;
• Fraudulent self-referral — using their own Coupon for themselves or creating fake sign-ups solely to generate Cashback;
• Buying traffic or ads on the "PowerMarketing" brand or variations as a keyword, or creating pages/domains impersonating PowerMarketing;
• Typosquatting, phishing, or posing as an official representative, employee or partner of PowerMarketing;
• Associating PowerMarketing with illegal, offensive, discriminatory, adult or violent content, or content that infringes third-party rights;
• Manipulating cookies, referral attribution or any Program mechanism fraudulently;
• Encouraging third parties to engage in any of the above.

Breaching these rules may result in the loss of related Cashback and termination of participation.

7. Suspension and termination

7.1. The Affiliate may end their participation at any time, free of charge.

7.2. PowerMarketing may suspend or terminate an Affiliate's participation, and withhold or cancel Cashback of irregular origin, in case of breach of these Terms, fraud, abuse or risk to the integrity of the Program or brand.

7.3. Cashback legitimately accrued and already released before termination remains due, except in cases of fraud.

8. Brand and intellectual property

8.1. The PowerMarketing brand, logo, materials and content belong to PowerMarketing. The Affiliate receives a limited, non-exclusive and revocable authorization to promote PowerMarketing solely within the Program.

8.2. This authorization transfers no ownership right and may be revoked at any time. Registering trademarks, domains or profiles that may be confused with PowerMarketing is prohibited.

9. Privacy and data protection

The processing of personal data within the Program follows applicable law and PowerMarketing's Privacy Policy. The Affiliate agrees to handle any third-party data they collect in their promotional activity in compliance with the law.

10. Changes to these Terms

PowerMarketing may update these Terms at any time to reflect changes in the Program, the law or its practices. Changes take effect upon publication on this page. Continued use of the Program after publication means acceptance of the current version.

11. General provisions

11.1. Tolerance of any breach does not imply waiver of rights.

11.2. If any clause is held invalid, the remaining clauses stay in full force.

11.3. These Terms are governed by Brazilian law.

In short: joining is free and creates no employment link. You promote your Coupon however you like, offer 20% off to those you refer, and receive 30% Cashback on every payment — paid into your Stripe account as soon as it is released, within up to 45 days. Act honestly and respectfully, and the Program will only bring you benefits.
